Nook Outdoors (“Nook Outdoors,” “we,” “us,” or “our“) is committed to protecting your privacy and complying with applicable data protection laws, including the EU General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), among other regulations.
This Privacy Policy explains what personal information we collect through the Nook Outdoors website (https://www.nookoutdoors.com) and related services, how we use and safeguard that information, and your rights in relation to it. By using our site or providing us with personal information, you agree to the practices described in this Policy
If you do not agree with this Policy, please do not use our website. This Policy applies worldwide to all visitors and users of our site, with primary focus on users in the United States, and is designed to meet global privacy standards as a baseline for compliance.
Personal Data We Collect: We collect several types of information from and about you:
We do not intentionally collect any sensitive personal information (such as social security numbers, financial account passwords, or health information) through the site. We also do not actively collect special categories of personal data under GDPR (such as information about race, ethnicity, health, or political opinions). Any such data will only be processed if you choose to provide it and only in compliance with applicable law.
We use the personal information we collect for the following purposes:
We will only use your personal information for the purposes outlined above or for compatible purposes. If we need to use your data for an unrelated purpose, we will notify you and, if required, seek your consent.
Cookies: A cookie is a small text file that our site (or a third party) places on your device’s hard drive when you visit. We use cookies and similar tracking technologies to enable site functionality, enhance your browsing experience, and analyze usage of our site. The types of cookies we use include:
Google Analytics: As noted, we use Google Analytics, a web analytics service provided by Google. Google Analytics uses cookies to help analyze how users use the site. The information generated by the cookie about your use of our website (including IP address and usage data) will be transmitted to and stored by Google on servers (which may be in the United States or other countries). Google uses this information on our behalf to evaluate your use of the site, compile reports on website activity, and provide other services related to website usage. We share information with Google through the use of Google Analytics, and Google may process that information; however, this sharing is only for our analytics purposes.
Google is prohibited from using the data we share for purposes other than providing these services to us, under the Google Analytics terms of use. To learn more about how Google collects and processes data in connection with Google Analytics, you can visit Google’s site “How Google uses information from sites or apps that use our services,” or review Google’s privacy policy.
Your Choices for Cookies: On your first visit to our site (and periodically thereafter), you may be presented with a cookie notice or banner that invites you to consent to non-essential cookies. Where required by law (for example, if you are in the EU/EEA), we will not set analytics or advertising cookies on your device unless you allow them. You have the right to accept or reject cookies:
For more detailed information on the cookies and tracking technologies we use, you can contact us or (if available) refer to our separate Cookies Policy. By continuing to use our site without disabling cookies via your browser or opting out via the methods above, you consent to our use of cookies and similar technologies as described here.
We value your privacy and do not sell your personal information to third parties for their own marketing or commercial purposes.
This means we do not exchange your personal data for money. We also have no knowledge of any selling or sharing of personal information of minors under 16 (in compliance with California law).
However, we may disclose or share your information in the following circumstances, in accordance with this Policy:
In all cases of data sharing, we strive to disclose only the minimum necessary information to fulfill the purpose. Where applicable, we enter into data protection agreements (including Standard Contractual Clauses, as mentioned below, for international transfers) with third parties to safeguard your personal information. We also require third parties to whom we disclose personal data to comply with all relevant privacy laws and to provide adequate protection for your information.
Nook Outdoors is based in the United States, and the personal information we collect is primarily processed and stored on servers located in the U.S. However, we serve users around the world, and the data we collect may be transferred to, stored in, or accessed from countries outside of your country of residence. This includes transfers from the European Economic Area (EEA), the United Kingdom, or other regions with data protection laws, to our servers in the United States or to servers of our service providers in other countries.
Protection for EU/EEA and UK Data: If you are located in the EEA, UK, or Switzerland, we will ensure that adequate safeguards are in place for the transfer of your personal information out of those regions. These safeguards may include:
Regardless of where your information is processed, we will take appropriate steps to ensure it is treated securely and in accordance with this Privacy Policy and applicable law. We continuously monitor the legal landscape for international data transfers (such as changes in frameworks like the EU-U.S. Data Privacy Framework or updates to SCCs) and will adjust our practices as required to remain compliant.
Your Acknowledgment: By using our site or providing us with information, you understand that your personal data may be transferred to and processed in countries outside of your own, including the United States, which may have different data protection rules than your country. We will only conduct such transfers in compliance with applicable privacy laws and will protect your information as described in this Policy.
We will retain your personal information only for as long as necessary to fulfill the purposes for which we collected it, as outlined in this Policy, and to comply with legal requirements. The criteria used to determine our retention periods include the duration of our ongoing relationship with you (for example, as long as you have an account with us or continue to use our services), whether there is a legal obligation to retain data (such as record-keeping laws), and whether retention is advisable in light of our legal position (such as for applicable statutes of limitations, litigation, or regulatory investigations)
In practice:
When we no longer have a legitimate need or legal obligation to keep your personal information, we will securely dispose of it. This may involve deleting it, anonymizing it, or if deletion is not immediately feasible (e.g. stored in backups), securely isolating and protecting it until deletion is possible. We periodically review the data we hold and erase or anonymize personal data when it is no longer required. If you have any specific questions about our data retention practices for a certain type of data, you can contact us at the email provided in the Contact Information section.
You have rights and choices regarding your personal information. Nook Outdoors is committed to respecting these rights and has processes in place to enable you to exercise them. Please note that your rights may vary depending on applicable law in your jurisdiction (for example, residents of the European Economic Area and California have specific rights described below). We extend similar rights to all our users as a matter of good practice, where feasible. These rights include:
1. Access and Transparency: You have the right to request access to the personal information we hold about you.
This is sometimes called a “data subject access request.” Upon verification of your identity, we will provide you with information about whether we process your personal data and a copy of the data, including details on what we have, why we have it, and who we disclose it to, subject to some exceptions under law.
2. Correction (Rectification): You have the right to request that we correct or update any inaccurate or incomplete personal information we have about you.
If you believe any of your information in our records is incorrect, please let us know. We will update it as required. (For example, you can ask us to correct a misspelled name or an outdated email address.)
3. Deletion (Right to be Forgotten): You can request that we delete your personal information under certain circumstances.
For instance, if the data is no longer necessary for the purposes for which it was collected, or if you withdraw consent (where the processing was based on consent) and we have no other legal basis to continue processing. We will honor deletion requests to the extent required by applicable law. Please note that there are exceptions – we may retain certain information if necessary for legal obligations or legitimate interests, such as completing a transaction you initiated, record-keeping requirements, or for security purposes. If full deletion isn’t possible (e.g., information is stored in backups), we will take steps to securely isolate the data and prevent any further active use of it until deletion is possible.
4. Data Portability: In some jurisdictions (including the EEA), you have the right to data portability. This means you can request a copy of the personal data you provided to us in a structured, commonly used, and machine-readable format, and you have the right to transmit that data to another service provider. Where technically feasible, and if requested, we can also transmit that data directly to another company at your direction.
Data portability rights apply when the processing is based on your consent or a contract with you, and the processing is carried out by automated means.
5. Withdrawal of Consent: Where we rely on your consent as the legal basis for processing your personal information (such as for sending marketing emails or certain cookie use), you have the right to withdraw your consent at any time.
For example, you can opt out of our newsletter by clicking the “unsubscribe” link in any marketing email or by contacting us. Withdrawing consent will not affect the lawfulness of processing that was done based on consent before its withdrawal. If you withdraw consent for cookies, you can adjust your browser settings or use our cookie management tool as described above under Cookies.
6. Objection to Processing: (Applicable in certain jurisdictions like the EU) You have the right to object to our processing of your personal information in certain situations. In particular, you can object if we are processing your data based on our legitimate interests or for direct marketing.
7. Restriction of Processing: You have the right to request that we limit the processing of your personal information under certain conditions.
This right is available, for example, if you contest the accuracy of your data (for a period enabling us to verify it), or if you have objected to processing and we are considering your request, or when processing is unlawful but you prefer restriction over deletion. When processing is restricted, such data will be marked and only processed for certain purposes (such as with your consent or for legal claims). We will inform you when a restriction is lifted.
8. California Privacy Rights: If you are a resident of California, you are entitled to specific rights under the CCPA (as amended by the CPRA), in addition to the general rights above. These include:
9. Other State/International Rights: Depending on your locale, you may have additional privacy rights. For example, residents of certain U.S. states (such as Virginia, Colorado, Connecticut, Utah, etc.) have new privacy rights taking effect in 2023/2024 that are similar to those in the CCPA (like rights to access, delete, correct, opt-out of certain data uses, etc.). Likewise, Canadian and Australian privacy laws provide rights to access and correction. Nook Outdoors intends to respect applicable rights in those jurisdictions as well. You can contact us for more information or requests specific to your jurisdiction.
Exercising Your Rights: To exercise any of your rights or make a privacy-related request, please contact us using the information in the Contact Information section below. For efficiency, you may email us at info@nookoutdoors.com with your request and include “Privacy Request” in the subject line. Please clearly state your request, including which right you wish to exercise, and provide us with enough information to verify your identity. For certain requests (like access, deletion, or California-specific requests), we may need to ask for additional information to confirm that you are the person (or an authorized agent of the person) whose data is the subject of the request, for security purposes. We will only use such additional information for verification and to fulfill your request.
Response Time: We will respond to legitimate requests as soon as possible, and within the timeframes required by law. Under GDPR/EEA rules, we typically have one month to respond, which can be extended by two further months for complex requests (we will inform you if an extension is needed). Under CCPA, we aim to respond within 45 days of receiving your verifiable request (which may be extended by an additional 45 days if necessary with notice to you). If we cannot fulfill your request (for example, due to a legal exception), we will explain the reason in our response.
No Fee Usually Required: You will not have to pay a fee to exercise these rights. However, if a request is manifestly unfounded or excessive (for instance, repetitive requests), we may charge a reasonable fee or refuse to act on the request, as permitted by law.
Right to Lodge a Complaint: If you believe we have infringed your privacy rights, you have the right to complain to a data protection authority. For individuals in the EEA, you may contact the supervisory authority in the country of your residence or where the issue occurred.
For example, in the UK this would be the Information Commissioner’s Office (ICO), and in Canada the Office of the Privacy Commissioner. We would, however, appreciate the chance to address your concerns before you approach a regulator, so please consider reaching out to us first, and we will do our best to resolve the issue.
We take the security of your personal information seriously. Nook Outdoors implements a variety of technical, administrative, and physical safeguards to protect your data from unauthorized access, disclosure, alteration, and destruction. These measures include, but are not limited to:
While we strive to protect your information, please be aware that no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, we cannot guarantee absolute security. You should also take care to protect your own credentials and devices. If you have a password for an account with us, keep it confidential and consider changing it periodically. Avoid using the same passwords across multiple websites. If you suspect any unauthorized access to your account or information, please contact us immediately.
Protecting the privacy of minors is especially important. Our website and services are not directed to children under the age of 16, and we do not knowingly collect personal information from anyone under 13 years of age without parental consent.
In accordance with the U.S. Children’s Online Privacy Protection Act (COPPA) and other applicable laws, if we learn that we have inadvertently collected personal data from a child under 13, we will take prompt steps to delete such information from our records.
If you are under 16, please do not use this site or submit any information about yourself to us.
Parents or guardians who believe that we might have any information from or about a child under the age of 13 may contact us using the information below. We will then take appropriate measures to investigate and, if applicable, delete the information.
For teens between 13 and 16 years old, we expect and assume that any personal information provided to us has been authorized by the teen’s parent or guardian as required by law. California residents under 18 years of age who have registered to use the site (if that functionality exists) and posted content or information can request removal of that content under California law. If you are a California minor who has posted content you wish to remove, please contact us for assistance.
We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons.
When we make changes, we will post the revised Privacy Policy on this page with a new “Last Updated” date. If the changes are significant, we may provide a more prominent notice (such as adding a statement on our homepage or emailing you if we have your contact information). We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your information
Your continued use of the Nook Outdoors website after any modifications to this Policy will signify your acceptance of the updated terms, to the extent permitted by law. If we seek to use your personal information for a new purpose not originally disclosed to you, we will endeavor to obtain your consent or provide you with an opportunity to opt-out, as required by applicable laws.
If you have any questions, concerns, or requests regarding this Privacy Policy or our handling of your personal information, please do not hesitate to contact us:
Email: info@nookoutdoors.com
(For privacy inquiries, please include “Privacy” in the subject line to ensure it reaches the correct team.)
